1. Introduction and Scope
This Domain Registration Agreement (“Agreement”) applies to all domain name services ordered through https://istanco.net/ from ISTIRIO LLC, operating under the ISTanCo brand (“ISTanCo”, “we”, “us” or “our”). These services include the registration, renewal, transfer, restoration and management of domain names, domain backordering and registrant change requests (“Domain Services”).
This Agreement supplements our Terms of Service. By ordering or using Domain Services, you agree to this Agreement, the Terms of Service and the policies referred to in this Agreement. If there is a conflict between this Agreement and the Terms of Service on a matter specific to domain names, this Agreement applies.
2. Definitions
- “Domain Name” means a domain name registered, renewed, transferred or managed through our Domain Services.
- “Registrant”, “you” or “your” means the person or entity in whose name a Domain Name is registered, or who orders Domain Services.
- “Registry” means the organization that operates the database of Domain Names for a top-level domain (TLD), such as .com, .net or .rs.
- “Registrar of Record” means the accredited registrar that sponsors the registration of a Domain Name with the relevant Registry.
- “gTLD” means a generic top-level domain, such as .com or .net, governed by the policies of the Internet Corporation for Assigned Names and Numbers (“ICANN”).
- “ccTLD” means a country code top-level domain, such as .rs, .fi or .si, governed by the policies of its Registry.
- “Registration Data” means the contact and technical information associated with a Domain Name, including registrant, administrative, technical and billing contact details and nameserver information.
- “Authorization Code” means the code used to authorize the transfer of a Domain Name between registrars.
3. Our Role
ISTIRIO LLC provides Domain Services as an authorized reseller of accredited registrar partners. ISTIRIO LLC is your contracting party for Domain Services. We accept your order, issue invoices, receive payment and provide customer support.
Each Domain Name is registered with the relevant Registry through a Registrar of Record. The Registrar of Record for each Domain Name is shown in the applicable WHOIS or RDAP record and is available from us upon request.
Where required by ICANN or a Registry, the registration terms of the Registrar of Record also apply to your Domain Name. We will provide those terms upon request.
4. Registry and ICANN Policies
Your registration and use of each Domain Name are subject to the policies, rules and procedures of the relevant Registry and, for gTLDs, the policies adopted by ICANN, as amended from time to time (“Applicable Policies”). You agree to comply with all Applicable Policies.
For gTLD Domain Names, Applicable Policies include, among others, the ICANN Transfer Policy, the Uniform Domain Name Dispute Resolution Policy (UDRP), the Expired Registration Recovery Policy and the ICANN registration data accuracy requirements. Information about your rights and responsibilities as a gTLD registrant is published by ICANN in the Registrants’ Benefits and Responsibilities: https://www.icann.org/resources/pages/benefits-2013-09-16-en
For ccTLD Domain Names, the policies of the relevant Registry apply. These policies may include eligibility requirements, documentation requirements, specific registration periods, transfer procedures and dispute resolution procedures that differ from those for gTLDs. You are responsible for reviewing the Applicable Policies before ordering a Domain Name.
Registries and ICANN may change their policies at any time. Changes take effect for your Domain Names as determined by the Registry or ICANN, even if this Agreement has not yet been updated.
5. Eligibility and Registration Requirements
Some TLDs are available only to registrants that meet specific requirements, such as a connection to a particular country, a registered trademark or a specific type of organization. By ordering a Domain Name, you confirm that you meet all eligibility requirements of the relevant Registry and that you will continue to meet them for the duration of the registration.
We or the Registry may request documents or information to verify eligibility. If you do not provide them, or if you do not meet the eligibility requirements, the Domain Name may be refused, suspended or deleted in accordance with the Applicable Policies.
6. Registration of Domain Names
- Domain Names are registered on a “first come, first served” basis, unless the Registry applies a different allocation procedure.
- Domain Name availability and prices shown on the Website are indicative only and depend on information from Registries and other third-party systems at the time of the search.
- A Domain Name is registered only when the registration has been confirmed by the Registry. We will send you a confirmation by email once the registration is completed.
- Registration periods, including minimum and maximum periods, depend on the TLD and are set by the Registry.
- Some Domain Names are classified by the Registry as premium names and are subject to higher registration and renewal fees. Premium pricing is shown at the time of order where available.
- If a Domain Name cannot be registered, we will inform you and refund the amount paid for that Domain Name or, at your choice, apply it to another service.
The registration of a Domain Name gives you the right to use that Domain Name for the registration period, in accordance with the Applicable Policies. It does not give you ownership or property rights in the Domain Name, and it does not give you trademark or other intellectual property rights in the name.
We may cancel a Domain Name registration that was completed because of a technical error, a pricing error or a Registry error, in which case we will refund the amount paid for that registration.
7. Accurate Registration Data
You must provide complete and accurate Registration Data when ordering a Domain Name and keep it accurate and up to date for the entire registration period. For gTLD Domain Names, you must update your Registration Data within seven (7) days of any change.
We, the Registrar of Record or the Registry may verify your Registration Data, for example by sending a verification email to the registrant email address. For gTLD Domain Names, if you do not complete a required verification within fifteen (15) days, the Domain Name may be suspended until the verification is completed.
Providing inaccurate or unreliable Registration Data, failing to update it promptly, or failing to respond within fifteen (15) days to an inquiry about the accuracy of your Registration Data is a material breach of this Agreement and may result in suspension or cancellation of the Domain Name.
8. Registration Data and Public Directories
To register and manage your Domain Names, we share your Registration Data with the Registrar of Record and the relevant Registry. Depending on the TLD, Registration Data may also be shared with ICANN, data escrow providers and other parties as required by the Applicable Policies.
Some Registration Data may be published in public WHOIS or RDAP directories. The data that is published depends on the policies of the relevant Registry and on applicable data protection law. In many cases, personal data of individual registrants is redacted from public directories, but it may still be disclosed to third parties with a legitimate interest, such as law enforcement authorities or rights holders, in accordance with the Applicable Policies and applicable law.
More information about how we process personal data is available in our Privacy Policy.
9. Registering a Domain Name on Behalf of Another Person
If you register a Domain Name on behalf of another person or license the use of a Domain Name to a third party, you remain the Registrant and are responsible for all obligations under this Agreement, including the accuracy of the Registration Data and compliance with the Applicable Policies.
If you license the use of a Domain Name to a third party, you accept liability for harm caused by the wrongful use of the Domain Name, unless you promptly disclose the current contact information of the licensee to a party providing reasonable evidence of actionable harm.
10. Renewal and Expiration
10.1 Automatic Renewal
Domain Names renew automatically before their expiration date, unless you disable automatic renewal, as described in Section 8 of our Terms of Service. A Domain Name is renewed only after payment for the renewal has been received.
10.2 Renewal Reminders
We send renewal reminders to the email address associated with your account. For gTLD Domain Names, we send reminders approximately one month and approximately one week before the expiration date, and one further reminder within five (5) days after expiration if the Domain Name has not been renewed. For ccTLD Domain Names, we send renewal reminders in advance of the expiration date as reasonably practicable.
You are responsible for keeping your account email address current. Failure to receive a reminder does not extend the expiration date of a Domain Name.
10.3 After Expiration
If a Domain Name is not renewed before its expiration date:
- the Domain Name may stop resolving, and websites and email services using it may stop working;
- where the Registry provides a renewal grace period, the Domain Name may be renewed at the regular renewal price during that period;
- after any renewal grace period, the Domain Name may enter a redemption period, during which it can be restored only by paying a restoration fee in addition to the renewal fee. For gTLD Domain Names, the redemption period is generally thirty (30) days. The restoration fee is quoted at the time of the request; and
- if the Domain Name is not renewed or restored, it will be deleted and may become available for registration by any other person.
Grace periods, redemption periods and deletion procedures vary by TLD and are set by the Registry. Some ccTLDs do not offer a grace period or redemption period.
11. Transfers
11.1 Transfers to Us
To transfer a Domain Name to us, you must have authority to request the transfer, the Domain Name must be unlocked at the current registrar, and you must provide a valid Authorization Code where required by the Registry. For many gTLDs, a transfer adds one year to the registration period. For ccTLDs, the effect of a transfer on the registration period depends on the Registry.
A transfer is completed only when the Registry confirms it. If a transfer cannot be completed, we will inform you and, at your choice, refund the transfer fee or apply it to another service.
11.2 Transfers Away from Us
You may transfer your Domain Name to another registrar in accordance with the Applicable Policies. We will provide the Authorization Code and remove any transfer lock upon your request through the Client Area or a support ticket, unless a transfer is not permitted under the Applicable Policies.
A transfer may be refused or delayed where permitted or required by the Applicable Policies, for example:
- within a period after the initial registration, a previous transfer or a change of registrant, where the Registry or ICANN Transfer Policy applies such a restriction;
- where the Domain Name is subject to a dispute resolution proceeding, court order or Registry lock;
- where the Domain Name has expired or is in a redemption period; or
- where there is reasonable evidence of fraud or that the transfer was not requested by the Registrant.
Fees paid for the current registration period are not refunded when a Domain Name is transferred away.
12. Change of Registrant
A change of the Registrant of a Domain Name is subject to the procedures of the relevant Registry and the Applicable Policies. Depending on the TLD, a change of registrant may require confirmation by both the current and the new Registrant, the submission of documents, or the payment of a fee shown at the time of order.
For .rs Domain Names, a confirmation email is sent to both the current and the new registrant email addresses, and each party must approve the change by following the link provided. The change is completed only after both approvals have been received and the Registry has processed the change.
For gTLD Domain Names, a change of registrant may result in a temporary restriction on transfers to another registrar, in accordance with the ICANN Transfer Policy.
13. Domain Backordering
A backorder is a request for us to attempt to register a Domain Name if it becomes available after deletion. We do not guarantee that a backorder will be successful, as the Domain Name may be renewed or restored by its current Registrant, or registered by another party.
If a backorder is successful, the Domain Name will be registered in your account under this Agreement, and the applicable fees are non-refundable. If a backorder is not successful, no registration fee is charged or, if a registration fee has been paid, it will be refunded.
Lists of recently expired domain names, short domain names and similar lists on the Website are provided for information only. Availability is not guaranteed until a Domain Name is successfully registered.
14. Nameservers and DNS
DNS management is included with Domain Names registered through us. You are responsible for configuring nameservers and DNS records correctly. We are not responsible for service interruptions caused by incorrect DNS configuration or by third-party DNS or hosting providers.
15. Fees and Refunds
Fees for Domain Services are shown on the Website at the time of order and are billed in U.S. dollars (USD) in accordance with our Terms of Service. Registration, renewal, transfer, restoration and registrant change fees may change if a Registry or Registrar of Record changes its fees.
Domain name registrations, renewals, transfers, restorations and processed registrant changes are non-refundable, except as stated in Sections 6, 11.1 and 13 of this Agreement or as required by applicable law. Refunds are described in more detail in our Refund & Cancellation Policy.
16. Prohibited Use, Suspension and Cancellation
You may not use a Domain Name for any unlawful purpose or in violation of the Applicable Policies or our Acceptable Use & Abuse Policy, including for phishing, malware distribution, spam, fraud, infringement of intellectual property rights or the distribution of child sexual abuse material.
We, the Registrar of Record or the Registry may lock, suspend, transfer, cancel or modify a Domain Name, or deny or reverse a registration, renewal or transfer:
- to comply with the Applicable Policies or applicable law;
- to comply with a court order, a decision under a dispute resolution policy or a request from a competent authority;
- to correct errors made by us, the Registrar of Record or the Registry;
- to protect the integrity and stability of the Registry or the domain name system;
- where the Domain Name is used for abuse or illegal activity; or
- where you breach this Agreement, including by providing inaccurate Registration Data.
Fees paid for a Domain Name that is suspended or cancelled under this Section are not refundable, except where the cancellation results from an error made by us.
17. Domain Name Disputes
You are solely responsible for ensuring that your registration and use of a Domain Name do not infringe the rights of any third party. By registering a Domain Name, you confirm that, to the best of your knowledge, the registration and use of the Domain Name do not infringe the rights of any third party.
For gTLD Domain Names, you agree to submit to proceedings under the Uniform Domain Name Dispute Resolution Policy (UDRP) and any other dispute resolution procedure required by ICANN or the Registry. For ccTLD Domain Names, you agree to submit to the dispute resolution procedures of the relevant Registry.
We do not take part in disputes between you and third parties regarding Domain Names. We will implement decisions of dispute resolution providers, courts and competent authorities as required by the Applicable Policies. During a dispute, a Domain Name may be locked to prevent its transfer or modification.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless ISTIRIO LLC, the Registrar of Record and the Registry, and their respective owners, directors, officers, employees and agents, from any claims, losses, liabilities, damages and reasonable costs, including reasonable legal fees, arising from your registration or use of a Domain Name.
19. Limitation of Liability
The limitation of liability in our Terms of Service applies to Domain Services. In addition, to the extent permitted by applicable law, neither we, the Registrar of Record nor the Registry are liable for any loss arising from:
- the registration or non-registration of a Domain Name, or the registration of a Domain Name by another party;
- the expiration, suspension, cancellation or transfer of a Domain Name in accordance with this Agreement or the Applicable Policies;
- the processing of a Domain Name by the Registry, including delays or errors by the Registry; or
- the use of a Domain Name by you or any third party.
20. Term and Termination
This Agreement applies to each Domain Name for as long as it is registered or managed through us. It ends for a Domain Name when the Domain Name is transferred to another registrar, deleted or cancelled. Sections 9, 15, 17, 18 and 19 continue to apply after termination.
21. Governing Law and Dispute Resolution
The governing law and dispute resolution provisions of our Terms of Service apply to disputes between you and us under this Agreement. Disputes between you and third parties concerning the registration or use of a Domain Name are subject to the dispute resolution procedures described in Section 17 and to any law required by the Applicable Policies.
22. Changes to This Agreement
We may update this Agreement from time to time, including to reflect changes in the Applicable Policies. The updated version will be published on the Website with a new effective date. If we make material changes, we will notify you by email or through the Client Area before the changes take effect, unless a change is required by a Registry, ICANN or applicable law with shorter notice.
